No. Absolutely not.

"Incapacitation" was abolished in Germany in 1992. Legal guardianship is something completely different:

  • You retain all your rights.
  • You can still sign contracts and vote.
  • Guardianship is support – not taking over your life.

Yes, you can.

According to § 1816 BGB, you have a right of preference: You can suggest a specific person as guardian or say who you do not want.

No. That is prohibited.

Modern guardianship law (reformed in 2023) states clearly: The guardian must determine and follow your wishes. They may only act differently if you would otherwise face significant harm.

Often nothing for you.

With assets under €10,000 (protected assets), the state pays the costs. With higher assets, you pay the legally determined fee yourself.

Yes, that is often possible.

The best precaution: A power of attorney. With this, you determine who handles your affairs. The court will then not appoint a guardian.

I advise you honestly – if a power of attorney is the better solution, I will tell you.
